The Civil War Service of Edward J. Culbertson, Substitute and Volunteer

From Chancery Court Case 1875-04

Edward J. Culbertson was in his 37th year when he and E. S. Fugate entered into a contract dated 18th July 1862 and filed under Wm J Dickinson's deposition, and E. S. Fugate was in his 32nd year.



7-18-1862

I Elbert S. Fugate of Russell County & State of Virginia, bind myself my heirs &c to give Edward J. Culbertson the sum of eight hundred dollars & interest on the same...Upon the following conditions viz. Culbertson goes in Capt. Caldwell Company as substitute for said Fugate. If said Culbertson is called on said Fugate takes his place in the militia...Said Culbertson gets the bounty as a volunteer and all the pay. Witness our hands & seals this 18th day July 1862.




This is to certify that I have this day received as a substitute for three years or during the War, Edward J. Culbertson as a substitute for Dr. Elbert S. Fugate of the county of Russell and state of Virginia. Sd. Culbertson is a stout able bodied man, and an able and efficient soldier.

This is to certify that I hired Ed. J Culbertson as a substitute and to serve as such until conscripts were called over the age of 35 years at which time our contract ceased and as his pay stoped in prop[...] said time and I therefore do not claim him as my substitute at this time.

Elbert S. Fugate is hereby declared exempt from military service by reason of being Physician in County of Russell. when he ceases to be employed as such this exemption is declared void.
